The Kel Tec PLR-16 Is A Pistol And Not An AOW In Virginia

I learned something new today. I have been scouring the blogs looking for answers pertaining to the purchase of a Kel Tec PLR-16. The firearm is a gas operated, semi-automatic pistol chambered in 5.56x45 Nato caliber. The rifling is 1 turn in 9 inches, right hand twist. It features a long stroke gas-piston operation with the Johnson/Stoner breech locking system. The rear sight includes a windage adjuster, while the front sight is similar to to an AR-15 style rifle and adjustable for elevation. I've heard from a few PLR owners who say the factory sights suck, so if you plan on purchasing one then I suggest you put a red dot sight on it. Kel TEC integrated a MIL-STD-1913 picatinny rail on the top mount for all your standard accessories. The muzzle is threaded 1/2-28 TPI to accept standard attachments such as a muzzle brake or flash hider. The coolest features of the this pistol is that except for the barrel, bolt, sights, and mechanism, the PLR-16 pistol is made entirely of high-impact glass fiber reinforced polymer. This brings the unloaded weight to 3.4lbs. To give you a comparison, a military standard Colt M4 AR-15 weighs approximately 6.36lbs unloaded.

With all of these great features, plus the fact that this pistol isn't always readily available I decided to put one on layaway at Budsgunshop.com last month. I first saw the PLR 2 years ago on Bud's website and since then, I haven't seen them until last December. You can purchase your own from Budsgunshop here, as they have them in stock now. Kel Tec CNC Industries. Inc. was founded 1991 in Cocoa , Florida. Initially a CNC machine shop making firearms components for Grendel Inc., Kel-Tec started to manufacture firearms in 1995 with the P-11. Specializing in innovative rifle designs and handguns for concealed carry by law enforcement personnel and qualified citizens, According to the ATF, Kel Tec is the third-largest handgun manufacturer in the U.S.

Now here comes the slightly disturbing part. I didn't know this firearm was classified in my resident state of Virginia. I did know that it wasn't a Class III firearm. If you're unfamiliar with this category it includes short-barreled shotguns and rifles, silencers and any automatic firearms. In order to get firearms of this type, you must go through a slew of paperwork and a much larger background check. Plus there is a $200 tax stamp on every purchase that meets the Class III standards. If you ever need a copy of Form 4 there you go, you can thank me later.



The other tax stamp is $5 dollars, and it pertains to "AOW" weapons. These are known as "any other weapon". Here is the law as stated...

"The term ‘‘any other weapon’’ means any weapon or device capable of being concealed on the person from which a shot can be discharged through the energy of an explosive, a pistol or revolver having a barrel with a smooth bore designed or redesigned to fire a fixed shotgun shell, weapons with combination shotgun and rifle barrels 12 inches or more, less than 18 inches in length, from which only a single discharge can be made from either barrel without manual reloading, and shall include any such weapon which may be readily restored to fire. Such term shall not include a pistol or a revolver having a rifled bore, or rifled bores, or weapons designed, made, or intended to be fired from the shoulder and not capable of firing fixed ammunition"



The Kel Tec doesn't meet the requirements to be an AOW because the barrel is shorter than 12 inches, and it doesn't have a stock on it. If you were to put a stock on it, that would classify the firearm as being a Class III (short barreled Rifle). Also if you were to add a vertical foregrip, that would also classify it as an AOW.
